ADA Chair lift compliance

I am writing to you concerning some of the difficulties I have experienced in regards to health facilities refusing to have an ADA chair lift, despite communication with the facility, its managers as well as the corporate office. They ignored my letters as well as an ADA attorney. A second facility that is a PT clinic and a gym operating out of the same physical space also has a pool and they recently informed me since the building was built awhile back (prior to ADA?) they are exempt and this was agreed upon by their corporate lawyers. I pursed this through the company compliance hotline. I then replied to the compliance representative that since the corporation accepts federal dollars (Medicare and Medicaid) they need to be compliant. Do you have any information that I can use to further pursue my claim? I would be willing to share my experiences with your network in an article.

It is true that facilities have been grandfathered into some of the new standards as long as they don't renovate. However, as Peggy always says, That doesn't mean that they can't be sued by individuals for failure to accommodate. It just means that they won't be pursued by the Justice Department.
